CITY OF BOWLING GREEN CITY COUNCIL

 

MONDAY, NOVEMBER 17, 2008

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, and Planning Director Rick Ketzenbarger.  Utilities Director Kevin Maynard and Clerk of Council Kay Scherreik were not present.  Acting Clerk Michelle Fitzgerald attended the meeting in her absence.

 

Council President Newlove declared the minutes of the meeting held October 2, 2007 approved as distributed.

 

 

CORRESPONDENCE

 

Acting Clerk noted that a list of budget transfers for the month of November was received from Finance Director Brian Bushong and distributed to Council prior to the meeting.   Council Member Heminger moved, Frost seconded, to approve the transfers as presented.   On unanimous voice vote, Council President Newlove declared motion carried.    A copy of the transfers is attached and made a part of these minutes.

 

Acting Clerk noted that an application for a new Class D3 liquor permit was received from the Ohio Division of Liquor Control for Chung Uraku LLC, located at 1616 East Wooster Street, Bowling Green, Ohio.  A check of the records has been requested from the Police Division but not yet received.

 

 

OFFICIAL REPORTS

 

Mayor John Quinn announced that the annual Christmas tree lighting will be held Friday, November 21, 2008 at 7:00 p.m. and the holiday parade will take place Saturday, November 22, 2008 at 10:00 a.m.   Mayor Quinn also noted that the Bowling Green Family of The Year will be announced Sunday, November 23, 2008 at the Church of the Latter Day Saints.

 

Mayor Quinn noted that the last of the BG 175th anniversary events will be held at the Woodland Mall on Sunday, December 7, 2008 from 1:00 p.m. to 4:00 p.m.   The Mayor further noted that the committee has worked hard over the past year and a half and may make a small profit.

 

Mayor Quinn thanked Finance Director Brian Bushong, Municipal Administrator John Fawcett, and Assistant Municipal Administrator Lori Tretter for their hard work on the budget during what has been a difficult budget year.

 

            Municipal Administrator John Fawcett had no report.   Council Member McOmber asked Mr. Fawcett if snow removal from sidewalks not shoveled in accordance with the City’s ordinances would be handled the same as last year.  Mr. Fawcett responded that it would be handled the same and there will be no change to the fee people are charged.  Public notices have been published and notices have been mailed to individuals who had issues last year in order to be proactive.

 

            Planning Director Rick Ketzenbarger had no report.

 

Parks and Recreation Director Dr. Michelle Grigore announced the appointment of Eric Fletcher as Sports Specialist as of November 17, 2008.  Mr. Fletcher formerly worked for the City of Bluffton, Ohio as a Sports Coordinator.  He started work November 17, 2008.

 

City Attorney Michael Marsh had no report.

 

Utilities Director Kevin Maynard was not present.

 

Public Works Director Brian Craft had no report. 

 

 

NEW LEGISLATION

 

The following new legislation was recommended by the Administration and presented to Council for introduction:

 

Council President Newlove, for the Finance Committee, introduced an ordinance amending and adopting Section 33.31(C) & (D) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to uniforms for City employees.

 

Council Member Frost, for the Planning and Zoning Committee, introduced an ordinance amending the zoning district map of the City of Bowling Green, Ohio for the property generally known as 520 and 522 Ordway Avenue from M-1 light industrial to B-4 office district zoning.

 

 

COUNCIL COMMITTEE REPORTS

 

Council President Newlove, for the Finance Committee, announced that budget hearings will take place on Tuesday, November 18 and Thursday, November 20, 2008 beginning at 1:30 p.m. in the Council Chamber.

 

 

LOBBY VISITATIONS

           

            Barbara Allen, a three year resident of State Street, said that she has recently replaced her mailbox for the fourth time due to college students using the street as a thoroughfare at night and knocking over mailboxes and trash cans in the neighborhood.  Other residents of the street have the same issue.  Council Member Dunn asked if these are deliberate acts of violence and Ms. Allen confirmed that they are.  She asked if there could be a fence or barricade put up to block access.  Public Works Director Brian Craft said he would go look at the area and see if a barricade could be erected.  Council Member Dunn asked Mr. Craft to report his findings at the next council meeting.

 

 

READING OF LEGISLATION         

           

            Acting Clerk read Ordinance #7841 amending and adopting Section 33.31 (C) & (D) of the Codified Ordinances of the City of Bowling Green, Ohio relating to uniforms of City employees, for first reading.

 

Acting Clerk read Ordinance #7842 amending the zoning district map of the City of Bowling Green, Ohio for the property generally known as 520 and 522 Ordway Avenue from M-1 light industrial to B-4 office district zoning, for first reading. 

 

Council Member Frost scheduled a public hearing for Ordinance #7842 for January 5, 2009 at 7:45 p.m.

 

Acting Clerk read Ordinance #7840 amending and adopting Section 33.04 of the Codified Ordinances of the City of Bowling Green, Ohio relative to pay scales, for second reading.

 

Acting Clerk read Resolution #3374 authorizing the Finance Director to establish a special revenue fund entitled “Indigent Drivers Interlock and Alcohol Monitoring Fund” for the City of Bowling Green, Wood County, Ohio, for third reading.

 

Council President Newlove moved, Zanfardino seconded, to adopt Resolution #3374.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared the motion carried, and Resolution #3374 adopted.

 

            Acting Clerk read Resolution #3375 authorizing the City Attorney to petition the Board of County Commissioners of Wood County, Ohio, to change township lines, for third reading. 

 

            Council Member Frost moved, McOmber seconded, to adopt Resolution #3375.  On roll call vote, Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared the motion carried, and Resolution #3375 carried.

 

Acting Clerk read Ordinance #7837 authorizing the Municipal Administrator to enter into a contract with the Bowling Green Convention and Visitors Bureau for the promotion and publicizing of the City of Bowling Green, Ohio to bring the patronage and business of cultural, educational, religious, professional and sports organizations into the City for the benefit of the citizens of the city and the business community thereof, for a period of one(1) year, and authorizing the payment of 55% of the revenue generated by the hotel-motel tax for said purpose, for third reading.

 

Council President Newlove moved, Frost seconded, to adopt Ordinance #7837.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7837 adopted.

 

            Acting Clerk read Ordinance #7839 amending and adopting changes to certain sections of Chapter 93 of the Codified Ordinances of the City of Bowling Green, Ohio regarding fire protection and prevention, for third reading.

 

            Council Member Sorrells moved, McOmber seconded, to adopt Ordinance #7839. On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7839 adopted.

 

            Council Member McOmber moved, Council Member Frost seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the November 17, 2008 regular meeting of the City Council at 8:15 p.m., subject to call.
