MONDAY, FEBRUARY 19, 2008

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.

 

Council Member Frost requested that the minutes be corrected to omit him from the roll call voting for the passage of legislation as he was absent from the last Council meeting.  Council President Newlove declared the minutes of the meeting held February 4, 2008 approved as corrected.

 

 

CORRESPONDENCE

 

                Clerk noted that a listing of budget transfers for the month of February was received from Finance Director Brian Bushong and distributed to Council prior to the meeting for approval.  Council Member Sorrells moved, Zanfardino seconded, to approve the transfers as presented.  On unanimous voice vote, Council President Newlove declared motion carried.  A copy of the transfers is attached and made a part of these minutes.

 

            Clerk also noted that copies of the Budget Summary Report for the months of December 2007 and January 2008 were distributed to Council prior to this evening’s meeting.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn introduced Erin Hackel from the American Red Cross and presented her with a cash donation for flood relief victims in the Findlay area.  Mayor Quinn also reminded citizens of the 175th birthday party for the City that will be held at the Woodland Mall on Saturday, February 23, from 1-4 p.m.

 

            Municipal Administrator John Fawcett invited interested Council Members to attend the 15th Annual Wood County Economic Development meeting that will be held on March 19 at the Perrysburg French Quarter.  Reservations can be made through the Mayor’s office.

 

            Fawcett noted that the City’s Arborist reported processing the 10,000th tree request from citizens since he was hired by the City three and a half years ago.

 

            Council Member Dunn thanked Fawcett and the Clerk of Council for the research work done regarding the history of rubbish pickup throughout the city.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Committee Michelle Grigore reported that the drive to raise $700,000 to help develop the Simpson Garden Park has reached $630,000 with hopes of reaching the goal by the end of the year.  Grigore also reported that the “Save the Woods” fundraising campaign will kick off on March 29 from 10 a.m. to 1 p.m. at the Rotary Nature Center.  The goal is to raise $480,000 to pay off the debt the city assumed to purchase the 19.6 acres added to the Wintergarden/St. John’s Nature Preserve.

 

            City Attorney Michael Marsh had no report.  Council Member Dunn asked the City Attorney about options Council has regarding the S-District Site Plan for the Wood County Hospital in light of the referendum petition citizens are in the process of filing against the zoning of the residential property.  City Attorney responded indicating that

 

 

the two are separate issues.  Marsh noted that if the S-District Site Plan is approved and there are enough signatures on the referendum petition to take the rezoning issue to the ballot in November, then the hospital will have to identify where the other required parking spaces will be located.  Marsh further noted that this is why the issue of rezoning and the site plan were separated and considered as two separate issues.

 

            Utilities Director Kevin Maynard had no report.

 

            Public Works Director Brian Craft reported that a pre-construction meeting for the Klotz Road/Gypsy Lane Road sewer project will be held on Friday, February 22, at 9:00 a.m. in the Council Chamber.  Craft also noted that samples of the Toter containers for recycling are on display in the hallway.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and execute a contract upon grant application approval under the Community Development Block Grant:  Entitlement Program as authorized by the Housing and Community Development Act of 1974, as amended.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance amending and adopting Section 33.27 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to vacations.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance certifying unpaid cost of snow removal to the County Auditor for placement on the tax duplicate.

 

            Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2008 and ending December 31, 2008.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to advertise for bids and enter into a contract or contacts, and/or to participate in the State of Ohio purchasing programs for the purchase of vehicles and equipment, as well as authorizing the trade-in, transfer or sale of vehicles and equipment utilized by the utility divisions.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance amending and adopting Section 51.06 of the Codified Ordinances of the City of Bowling Green, Ohio, relative to back flow prevention.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the purchase of agricultural drainage system materials for approximately 100 acres of the 300 acres of city owned property near the intersection of Carter Road and Anderson Road.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance accepting annexation for approximately 21.6130 acres of land in Plain Township, Wood county, Ohio, from Bowling Green Christian Academy, petitioners.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending and adopting Section 150.21 of the Codified Ordinances of the City of Bowling Green, Ohio, with respect to entranceways in the B-3 Central Business District.

 

 

 

COUNCIL COMMITTEE REPORTS

 

            Council Member Sorrells introduced Wendy Stram, Executive Director of the Bowling Green Convention & Visitors Bureau.  Ms. Stram reviewed the bureau’s annual report and highlighted events of the past year and upcoming events.

 

 

LOBBY VISITATIONS

 

            Several residents from the Larch Landing development addressed Council regarding their petition for city services submitted to Council.  Copies of their remarks were provided to the Clerk of Council and are attached to and made a part of these minutes.  The residents who addressed Council are as follows:

 

·         Steve McEwen – 1053 Pinewood Court

·         Dick Horton – 1036 Willowood Circle

·         Dick Bowers – 235 Willowood Circle (on behalf of himself and Tyne Hyslop)

·         Doug Craig – 1051 Pinewood Court

·         Sandy Rowland – 200 Larchwood Drive

 

Colleen Smith, 1126 Clark Street, addressed Council noting that she was the Municipal Administrator at the time Larch Landing was developed.  Mrs. Smith wanted to clarify that there wasn’t any animosity between the City and the developer and that efforts were made on the part of the City to convince the developer to make the streets in Larch Landing public streets.  Mrs. Smith noted that it was the developer’s decision not to build public streets in order to maximize the number of lots within the development.

 

 

READING OF LEGISLATION

 

            Clerk read Resolution #3358 transferring previously appropriated funds, for first reading.

 

            Council Member Newlove moved, Frost seconded, to suspend the rules and give Resolution #3358 its second and third reading.  On roll call vote, Council Members  Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Resolution #3358 for second and third reading by number and title only.

 

            Council Member Newlove moved, Heminger seconded, to adopt Resolution #3358.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Resolution #3358 adopted.

            Council Member Newlove moved, Dunn seconded, to amend Ordinance #7753 by substitution to add an emergency clause.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7753 amended by substitution.

 

            Council Member Newlove moved, McOmber seconded, to suspend the rules and give Ordinance #7753 its third reading.  On roll call vote, Council Members Zanfardino, Dunn, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Ordinance #7753 as amended for third reading by number and title only.

 

            Council Member Newlove moved, Heminger seconded, to adopt the emergency clause for Ordinance #7753 as amended.  On roll call vote, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Newlove moved, Zanfardino seconded, to adopt Ordinance #7753 as amended.  On roll call vote, Council Members  Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and Ordinance #7753 adopted as amended.

  

            Clerk read Ordinance #7754 amending and adopting Section 70.40(C)(2) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding inoperable vehicles, for second reading.

 

            Clerk read Ordinance #7742 amending and adopting Section 33.01(I), (M), (N), (O), and (P) of the Codified Ordinances of the City of Bowling Green, Ohio, relative to the non-bargaining salary schedule, for third reading.

 

            Council Member Newlove moved, McOmber seconded, to adopt Ordinance #7742.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7742 adopted.

 

            Clerk read Ordinance #7743 authorizing the Municipal Administrator to enter into a contract or contracts with specified vendors for work that may exceed $25,000 annually for calendar year 2008, for third reading.

 

            Council Member Newlove moved, Frost seconded, to adopt Ordinance #7743.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7743 adopted.

 

            Clerk read Ordinance #7744 authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for the cleaning of uniforms for the Department of Safety, for third reading.

 

            Council Member Newlove moved, Heminger seconded, to adopt Ordinance #7744.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7744 adopted.

 

            Clerk read Ordinance #7745 authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts and/or participate in State of Ohio purchasing programs for the purchase of vehicles and equipment as well as the trade-in or outright sale of vehicles and equipment being replaced, for third reading.

 

            Council Member Newlove moved, Zanfardino seconded, to adopt Ordinance #7745.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7745 adopted.

 

            Clerk read Ordinance #7746 authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for sidewalk improvements, pavement striping, deicing salt, and improving streets, alleys, and other public ways in the City of Bowling Green, Ohio, for third reading.

 

            Council Member Sorrells moved, McOmber seconded, to adopt Ordinance #7746.  On roll call vote, Council Members Zanfardino, Dunn, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7746 adopted.

 

            Clerk read Ordinance #7747 authorizing the Municipal Administrator to seek qualifications and enter into a contract or contracts for design, engineering, right-of-way acquisition, construction, and other services relating to the improvements on North Main Street, for third reading.

 

            Council Member Sorrells moved, Heminger seconded, to adopt Ordinance #7747.  On roll call vote, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7747 adopted.

 

            Clerk read Ordinance #7748 authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for roof repair and/or replacement and facility repairs at city-owned buildings, for third reading.

 

 

 

            Council Member Heminger moved, Frost seconded, to adopt Ordinance #7748.  On roll call vote, Council Members  Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and Ordinance #7748 adopted.

 

            Clerk read Ordinance #7749 authorizing the Municipal Administrator to seek proposals and enter into a contract or contracts for aquatic facility professional design services, for third reading.

 

            Council Member Dunn moved, Zanfardino seconded, to adopt Ordinance #7749.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7749 adopted.

 

            Clerk read Ordinance #7750 authorizing the Utilities Director to solicit requests for qualifications and to execute an agreement or agreements for engineering design services and alternatives for the Water Pollution Control facility’s tertiary filter upgrade, for third reading.

 

            Clerk read Ordinance #7751 authorizing the Utilities Director to enter into a contract or contracts for the purchase of and/or replacement of parts and labor installation for the final settling tank drives located at the Wastewater Treatment Plant without advertising for competitive bids, for third reading.

 

            Council Member McOmber moved, Heminger seconded, to adopt Ordinance #7751.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7751 adopted.

 

            Council Member Frost moved McOmber seconded, to adopt Ordinance #7738 approving the S-District Site Plan with waivers for the Wood County Hospital.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7738 adopted.

 

Council Member Dunn moved, Heminger seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the February 19, 2008 regular meeting of the City Council at 9:20 p.m., subject to call.
