MONDAY, FEBRUARY 5, 2007

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.

 

Council President Newlove declared the minutes of the meeting held January 16,2007 approved as distributed.

 

 

CORRESPONDENCE

 

            Clerk noted that an application was received from the Ohio Division of Liquor Control for a transfer of a Class D5 liquor permit from Frick Entertainment V, Inc., located at 1720 E. Wooster Street, Bowling Green, Ohio, to Frickers Bowling Green 106, LLC, dba Frickers, at the same location.  Clerk further noted that a check of the records was requested but not yet received.

 

 

OFFICIAL REPORT

 

            Mayor John Quinn reported that Bowling Green has been selected as a Tree City USA city for the 27th consecutive year and will receive the Growth Award for the 14th consecutive year.  Mayor Quinn noted that more details regarding Arbor Day and the awards presentation will be forthcoming.

 

            Mayor Quinn invited interested Council Members to attend the Wood County Economic Development Council annual dinner on Wednesday, March 21st, at the Perrysburg French Quarter at 5:00 p.m.  Mayor Quinn encouraged Council Members to RSVP to his office as soon as possible as this event fills up quickly.

 

            Mayor Quinn announced that the Coalition for Youth & Families will be holding a meeting on Thursday, February 8, at 7:00 p.m. to discuss problems confronting junior high age students and the possibility of a youth center in Bowling Green.

 

            Mayor Quinn noted that the annual State of the City forum will be held on Wednesday, February 7th, at the Simpson Building beginning at 4:00 p.m. and asked interested Council Members to RSVP to Lori Tretter.

 

            Lastly, Mayor Quinn noted that interviews have begun for the position of Fire Chief and a decision is expected by the end of the week.

 

            Municipal Administrator John Fawcett had no report.

 

            Council Member Sorrells commented regarding a letter to the editor that he read that indicated that in 2005 sludge was applied to farm fields during the months of December, January and February and asked the Administration if that was the City’s current practice.  Fawcett deferred to Utilities Director Kevin Maynard who indicated that he would get the schedule information to Mr. Sorrells. 

 

            Council Member Heminger inquired about the progress of the Mercer Road crosswalk.  Fawcett responded that they are waiting for the necessary equipment to arrive either later this week or next.

 

            Planning Director Rick Ketzenbarger reported that effective January 31, 2007, the Code Enforcement Officer took over the duties of responding to complaints regarding the removal of snow from sidewalks.

        

 

Parks and Recreation Director Michelle Grigore had no report.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard had no report.

 

            Public Works Director Bill Blair had no report.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Dunn, for the Parks and Recreation Committee, introduced a resolution authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and enter into an agreement with Ohio Department of Natural Resources for the purpose of acquiring financial assistance from the Natureworks Program.

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced an ordinance amending and adopting Section 98.02(C) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding removal of snow and ice from walks, and declaring an emergency.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator and the Utilities Director to advertise for bids and enter into a contract or contracts and/or participate in State of Ohio purchasing programs for the purchase of vehicles and equipment as well as the trade-in or outright sale of vehicles and equipment being replaced, and declaring an emergency.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance amending and enacting Section 33.01(I) of the Codified Ordinances of the City of Bowling Green, Ohio, relative to the non-bargaining salary schedule.

 

            Council Member Sorrells, for the Transportation and Safety Committee, introduced an ordinance amending and adopting Section 98.06, Section 98.08 and Section 115.02(D), (E), & (F) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding sidewalks and advertising on public property.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to execute an agreement or agreements for equipment rental and related services for two membrane technology pilot studies at the Water Treatment Plant.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to execute Amendment III to the agreement with Reiss Environmental, Inc., for additional work connected with conducting two membrane technology pilot studies at the Water Treatment Plant.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance authorizing the Mayor to grant an easement to Buckeye Cablevision, Inc., and declaring an emergency.

 

 

COUNCIL COMMITTEE REPORTS

 

            There were no Council committee reports.

 

 

LOBBY VISITATIONS

 

            Wendy Stram, Director of the Bowling Green Convention & Visitors Bureau, gave Council an overview of 2006 bureau activities and reviewed the 2007 Strategic Plan.  A copy of the 2006 annual report and the strategic plan are attached and made a part of these minutes.

 

 

 

 

READING OF LEGISLATION

 

            Clerk read Resolution #3329 authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and enter into an agreement with Ohio Department of Natural Resources for the purpose of acquiring financial assistance from the Natureworks Program, for first reading.

 

            Council Member Dunn moved, McOmber seconded, to suspend the rules and give Resolution #3329 its second and third reading.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Resolution #3329 for second and third reading by number and title only.

 

            Council Member Dunn moved, McOmber seconded, to adopt Resolution #3329.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells,  Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Resolution #3329 adopted.

 

            Clerk read Ordinance #7645 authorizing the Municipal Administrator and the Utilities Director to advertise for bids and enter into a contract or contracts and/or participate in State of Ohio purchasing programs for the purchase of vehicles and equipment as well as the trade-in or outright sale of vehicles and equipment being replaced, and declaring an emergency, for first reading.

 

            Council Member Newlove moved, Zanfardino seconded, to suspend the rules and give Ordinance #7645 its second and third reading.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and rules suspended.

            Council Member Newlove moved, Dunn seconded, to adopt the emergency clause for Ordinance #7645.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Newlove moved, Frost seconded, to adopt Ordinance #7645.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7645 adopted.

            Council Member Zanfardino moved, Sorrells seconded, to adopt Ordinance #7647.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and Ordinance #7647 adopted.

            Clerk read Ordinance #7638 amending and adopting Section 101.11(F) and Section  101.05 (A) & (B) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to the hotel/motel tax, for second reading.

 

            Clerk read Ordinance #7639 authorizing an agreement between the City of Bowling Green, Ohio, and the Wood County Regional Airport Authority, for second reading.

 

            Clerk read Ordinance #7640 authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for sidewalk improvements, pavement striping, deicing salt, and improving streets, alleys, and other public ways in the City of Bowling Green, Ohio, for second reading.

 

            Clerk read Ordinance #7641 authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for tree plantings & tree maintenance for trees located within the public right-of-way of the City of Bowling Green, for second reading.

 

            Clerk read Ordinance #7642 authorizing the Municipal Administrator to enter into a contract or contracts with specified vendors for work that may exceed $25,000 annually for calendar year 2007, for second reading.

 

            Clerk read Ordinance #7643 rescinding Ordinance #7540 and authorizing the Utilities Director to execute a revised Hydro Projects Developmental Subscription and Cost Sharing Agreement with American Municipal Power-Ohio, Inc., for second reading.

 

            Clerk read Ordinance #7644 authorizing the Municipal Administrator to seek qualifications and enter into a contract or contracts for a city-wide traffic signal system study, for second reading.

 

            Clerk read Ordinance #7634 authorizing the Municipal Administrator to seek qualifications and enter into a contract or contracts for updates to the Existing Land Use Section of the City’s Comprehensive Master Plan, for third reading.

 

            Council Member Frost moved, Zanfardino seconded, to adopt Ordinance #7634.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7634 adopted.

 

            Clerk read Ordinance #7635 authorizing the Municipal Administrator to seek qualifications and enter into a contract or contracts for a parking study for the Central Business District of the City of Bowling Green, for third reading.

 

            Council Member Frost moved, Heminger seconded, to adopt Ordinance #7635.  On roll call vote, Council Members Zanfardino, Dunn, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7635 adopted.

 

            Clerk read Ordinance #7636 authorizing the Municipal Administrator to seek qualifications and enter into a contract or contracts for the development of traffic and recreation impact fees, for third reading.

 

            Council Member Frost moved, Dunn seconded, to adopt Ordinance #7636.  On roll call vote, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7636 adopted.

 

Council Member Frost moved, Dunn seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the February 5, 2007 regular meeting of the City Council at 8:38 p.m., subject to call.
