November 6 2006

MONDAY, NOVEMBER 6, 2006

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair, Assistant Utilities Director Paul Brock, and Planning Director Rick Ketzenbarger.  Utilities Director Kevin Maynard was not present.

 

Council President Newlove declared the minutes of the meeting held October 16, 2006 approved as distributed.

 

 

CORRESPONDENCE

 

            Clerk noted that three applications were received from the Ohio Division of Liquor Control regarding the following liquor permits:

 

·         transfer from Brewsters Pourhouse, Inc., dba Brewsters Pourhouse, located at 135 N. Main Street, Bowling Green, to BG Brewsters Ltd., dba Brewsters Pourhouse at the same location;

·         transfer from Checkers Pub, Inc., located at 809 S. Main Street, Bowling Green, to Checkers Pub., Inc., dba Checkers Pub, located at 149 N. Main Street;

·         new permit for Uraku, Inc. located at 1616 E. Wooster Street, Suite 6, Bowling Green, Ohio.

 

Clerk reported that a check of the records was received from the Police Division on the above applications and no detrimental information was noted.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn reported to Council that there has been a resignation on the Sidewalk Commission and that he is looking for a person who resides on the east side of Main Street to replace that individual.

 

            Municipal Administrator John Fawcett announced to Council the following upcoming events:

 

·         Veteran’s Day Celebration will be held on Saturday, November 11, at the Wood County Courthouse beginning at 2:00 p.m.;

·         Annual holiday tree lighting will be held on Friday, November 10, at 7:00 p.m. in front of the library;

·         Parking meter holiday begins on Saturday, November 11, and will run through Sunday, December 31;

·         Annual holiday parade will be held on Saturday, November 18, beginning at 10:00 a.m.

 

Planning Director Rick Ketzenbarger reported that a plan is available in his office for the proposed library parking lot if Council Members are interested in viewing it.

 

            Parks and Recreation Director Michelle Grigore had no report.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard was not present.

 

            Public Works Director Bill Blair had no report.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance accepting an easement agreement with the Northwestern Water and Sewer District of Wood County for the purpose of constructing a master meter pit.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance partially vacating an east-west alley running west of Meeker Street and parallel with an between Wallace Avenue and West Wooster Street.

 

 

COUNCIL COMMITTEE REPORTS

 

            Council President Newlove reported that Council’s Committee-of-the-Whole held a hearing earlier this evening regarding the revisions to the Downtown Section of the City’s Comprehensive Master Plan and no changes were recommended.

 

 

LOBBY VISITATIONS

 

            Earlene Kilpatrick, Main Street BG, reported to Council regarding the upcoming “Holly Days” events being held in Downtown Bowling Green.  Ms. Kilpatrick noted that there is a listing of evenings on their website at www.downtownbgohio.org .

 

 

READING OF LEGISLATION

 

            Clerk read Ordinance #7618 accepting an easement agreement with the Northwestern Water and Sewer District of Wood County for the purpose of constructing a master meter pit, for first reading.

 

            Council Member McOmber moved, Sorrells seconded, to suspend the rules and give Ordinance #7618 its second and third reading.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Ordinance #7618 for second and third reading by number and title only.

 

            Council Member McOmber moved, Sorrells seconded, to adopt the emergency clause for Ordinance #7618.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells,  Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7618.  On roll call vote, Council Members McOmber, Newlove, Sorrells,  Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7618 adopted.

 

            Clerk read Ordinance #7619 partially vacating an east-west alley running west of Meeker Street and parallel with an between Wallace Avenue and West Wooster Street, for first reading.

 

            Council Member Frost announced that a public hearing will be held regarding Ordinance #7619 on Monday, December 18, 2006, at 7:45 p.m. in the Council Chambers.

 

            Clerk read Resolution #3317 approving revisions to the Downtown Section of the Comprehensive Master Plan of the City of Bowling Green, Ohio, for second reading.

 

            Clerk read Ordinance #7612 amending and adopting Section 33.04 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding pay scales for seasonal employees, for second reading.

  

            Clerk read Ordinance #7613 amending and adopting Section 93.05 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding fires inside the city, for second reading.

 

            Clerk read Ordinance #7614 amending and adopting Section 93.52(B)(1) and Section 93.52(C) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding open burning in restricted areas, for second reading.

 

            Clerk read Ordinance #7615 accepting an easement from Debmar, Inc., for right-of-way purposes along East Gypsy Lane Road, for second reading.

 

            Clerk read Ordinance #7616 amending and adopting Section 150.66(A) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning monument signs, for second reading.

 

            Clerk read Resolution #3315 authorizing the City Attorney to petition the Wood County Board of Commissioners to annex portions of Campbell Hill Road owned by the City of Bowling Green, Ohio, for third reading.

 

            Council Member Frost moved, Heminger seconded, to adopt Resolution #3315.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Resolution #3315 adopted.

 

            Clerk read Ordinance #7609 authorizing the Utilities Director to seek qualifications and enter into a contract or contracts for engineering and architectural services for the electric-water-sewer operations complex, for third reading.

 

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7609.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7609 adopted.

 

            Clerk read Ordinance #7610 authorizing the Utilities Director to execute Amendment II to the agreement for consulting services between the City of Bowling Green and Reiss Environmental, Inc., and declaring an emergency, for third reading.

 

            Council Member McOmber moved, Sorrells seconded, to adopt the emergency clause for Ordinance #7610.  On roll call vote, Council Members Zanfardino, Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Tomashefski voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7610.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and Ordinance #7610 adopted.

 

Council Member Sorrells  moved, Zanfardino seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the November 6, 2006 regular meeting of the City Council at 8:20 p.m., subject to call.
