December 18 2006

MONDAY, DECEMBER 18, 2006

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair, Assistant Utilities Director Paul Brock, and Planning Director Rick Ketzenbarger.  Utilities Director Kevin Maynard was not present.

 

Council President Newlove declared the minutes of the meeting held December 4, 2006 approved as distributed.

 

 

CORRESPONDENCE

 

            Clerk noted that a listing of budget transfers for the month of December, 2006 was received from Finance Director Rebecca Underwood and distributed to Council prior to the meeting for approval.  Council Member Sorrells moved, Heminger seconded, to approve the transfers as presented.  On unanimous voice vote, Council President Newlove declared motion carried.  A copy of the transfers is attached and made a part of these minutes.

 

            Clerk noted that copies of the Budget Summary Report for the month of November, 2006 was distributed to Council prior to this evening’s meeting.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn ,Municipal Administrator John Fawcett, Planning Director Rick Ketzenbarger, Parks and Recreation Director Michelle Grigore, City Attorney Michael Marsh, and Assistant Utilities Director Paul Brock had no report.

 

            Public Works Director Bill Blair reported that unlimited heavy item pickup will be done during the week of 12/26 on the east side of Main Street and the week of 1/2/07 on the west side of Main Street.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance amending and adopting Section 33.39 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to shift differential pay.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance accepting an easement from the Bowling Green Community Development Foundation, Inc., for utility purposes.

READING OF LEGISLATION

 

            Clerk read Resolution #3328 transferring previously appropriated funds, for first reading.

 

            Council Member Newlove moved, Dunn seconded, to suspend the rules and give Resolution #3328 its second and third reading.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Resolution #3328 for second and third reading by number and title only.

 

            Council Member Newlove moved, Zanfardino seconded, to adopt Resolution #3328.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells,  Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Resolution #3328 adopted.

 

            Clerk read Ordinance #7632 amending and adopting Section 33.39 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to shift differential pay, for first reading.

 

            Clerk read Ordinance #7633 accepting an easement from the Bowling Green Community Development Foundation, Inc., for utility purposes, for first reading.

 

            Clerk read Resolution #3326 designating financial institutions as public depositories, for second reading.

 

            Council Member Newlove moved, Heminger seconded, to suspend the rules and give Resolution #3326 its third reading.  On roll call vote, Council Members McOmber, Newlove, Sorrells,  Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and rules suspended.

            Council Member Newlove moved, Zanfardino seconded, to adopt Resolution #3326.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Resolution #3326 adopted.

 

            Clerk read Ordinance #7625 to provide appropriations for the expenses and other expenditures of the City of Bowling Green, Ohio, for the fiscal year beginning January 1, 2007 and ending December 31, 2007, for second reading.

 

            Council Member Newlove moved, Sorrells seconded, to suspend the rules and give Ordinance #7625 its third reading.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and rules suspended.

            Council Member Newlove moved, Sorrells seconded, to adopt Ordinance #7625.  On roll call vote, Council Members Zanfardino, Dunn, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7625 adopted.

 

            Clerk read Ordinance #7626 authorizing the Municipal Administrator and the Utilities Director to enter into a contract with the Local Government Services Division of the State Auditor’s office, and declaring an emergency, for second reading.

 

            Council Member Newlove moved, Zanfardino seconded, to suspend the rules and give Ordinance #7626 its third reading.  On roll call vote. Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Council Member Newlove moved, Heminger seconded, to adopt Ordinance #7626.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells,  Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7626 adopted.

 

            Clerk read Ordinance #7628 authorizing the Utilities Director to enter into an agreement and/or contract with GIS Landmark of Howard, Ohio, for GIS data collection services for the electric distribution system, for second reading.

 

            Clerk read Ordinance #7629 accepting a temporary easement for construction purposes and a permanent easement for right-of-way and utility purposes from Paragon Properties, Inc., for second reading.

 

            Clerk read Ordinance #7630 accepting annexation of approximately 1.045 acres of land in Plain Township, Wood County, Ohio, from Brian & Andrea Wisniewski, petitioners, for second reading.

 

            Clerk read Ordinance #7631 establishing interim zoning of R-2 Single Family Residential zoning for the Wisniewski property on Conneaut Avenue recently annexed to the City of Bowling Green, for second reading.

 

            Clerk read Resolution #3319 authorizing the Finance Director to change the classification of the “Parking Meter Fund” and “Off-Street Parking Fund” by establishing a special revenue fund entitled “Parking Fund” for the City of Bowling Green, Wood County, Ohio.

 

            Council Member Newlove moved, McOmber seconded, to adopt Resolution #3319.  On roll call vote, Council Members McOmber, Newlove, Sorrells,  Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Resolution #3319 adopted.

 

            Clerk read Resolution #3320 authorizing the Finance Director to establish a special revenue fund entitled “Payroll Stabilization Fund” for the City of Bowling Green, Wood County, Ohio, for third reading.

 

            Council Member Newlove moved, Zanfardino seconded, to adopt Resolution #3320.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Resolution #3320 adopted.

 

            Clerk read Resolution #3321 authorizing the Finance Director to establish a capital project fund entitled “Equipment Capitalization Fund” for the City of Bowling Green, Wood County, Ohio, for third reading.

 

            Council Member Newlove moved, Frost seconded, to adopt Resolution #3321.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Resolution #3321 adopted.

 

            Clerk read Resolution #3322 authorizing the Finance Director to establish a capital project fund entitled “Facility Capitalization Fund” for the City of Bowling Green, Wood County, Ohio, for third reading.

 

            Council Member Newlove moved, Heminger seconded, to adopt Resolution #3322.  On roll call vote, Council Members Zanfardino, Dunn, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Resolution #3322 adopted.

 

            Clerk read Resolution #3323 authorizing the Finance Director to establish a capital project fund entitled “Roadway Capitalization Fund” for the City of Bowling Green, Wood County, Ohio, for third reading.

 

 

 

 

            Council Member Newlove moved, Zanfardino seconded, to adopt Resolution #3323.  On roll call vote, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Resolution #3323 adopted.

 

            Clerk read Resolution #3324 adopting and authorizing a Community Housing Improvement Program (CHIP) Policy & Procedure Manual for the period 2006 to 2009, as approved by the Ohio Department of Development, Office of Housing & Community Partnerships (OHCP), for third reading.

 

            Council Member Zanfardino moved, McOmber seconded, to adopt Resolution #3324.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and Resolution #3324 adopted.

 

            Clerk read Ordinance #7621 authorizing the Municipal Administrator to enter into a contract with the Bowling Green Convention & Visitors Bureau for the promotion and publicizing of the City of Bowling Green, Ohio, to bring the patronage and business of cultural, educational, religious, professional and sports organizations into the City for the benefit of the citizens of the City and the business community thereof, for a period of two (2) years, and authorizing the payment of 55% of the revenue generated by the hotel-motel tax for said purpose, and declaring an emergency, for third reading.

 

            Council Member Newlove moved, Zanfardino seconded, to adopt the emergency clause for Ordinance #7621.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells,  Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Newlove moved, McOmber seconded, to adopt Ordinance #7621.  On roll call vote, Council Members McOmber, Newlove, Sorrells,  Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7621 adopted.

 

            Clerk read Ordinance #7622 authorizing the Utilities Director to accept an easement agreement for utility purposes from Debmar, Inc., for third reading.

 

            Council Member McOmber moved, Sorrells seconded, to adopt Ordinance #7622.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7622 adopted.

 

            Clerk read Ordinance #7623 authorizing the Municipal Administrator to enter into a contract with the Wood County Health Department for housing code enforcement, and declaring an emergency, for third reading.

 

            Council Member Frost moved, McOmber seconded, to adopt the emergency clause for Ordinance #7623.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Frost moved, McOmber seconded, to adopt Ordinance #7623.  On roll call vote, Council Members Zanfardino, Dunn, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7623 adopted.

 

            Clerk read Ordinance #7624 amending and adopting Section 152.01(D) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding adoption of building codes, for third reading.

 

            Council Member Frost moved, Sorrells seconded, to adopt Ordinance #7624.  On roll call vote, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7624 adopted.

 

            Council Member Frost moved, Zanfardino seconded, to adopt Ordinance #7619 partially vacating an east-west alley running west of Meeker Street and parallel with and between Wallace Avenue and West Wooster Street.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and Ordinance #7619 adopted.

 

Council Member McOmber moved, Dunn seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the December 18, 2006 regular meeting of the City Council at 8:19 p.m., subject to call.
