August 21 2006

MONDAY, AUGUST 21, 2006

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino responded.  Council Member Frost was not present.  Also present were Mayor John Quinn, City Attorney Michael Marsh, Public Works Director Bill Blair, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.  Municipal Administrator John Fawcett and Parks and Recreation Director Michelle Grigore were not present.

 

Council President Newlove declared the minutes of the meeting held August 7, 2006 approved as distributed.

 

 

CORRESPONDENCE

 

            Clerk noted that a listing of budget transfers for the month of August was received from Finance Director Rebecca Underwood and distributed to Council prior to the meeting for approval.  Council Member Heminger moved, Sorrells seconded, to approve the transfers as presented.  On unanimous voice vote, Council President Newlove declared motion carried.  A copy of the transfers is attached and made a part of these minutes.

 

            Clerk also noted that copies of the Budget Summary Report for the month of July, 2006 was distributed to Council prior to this evening’s meeting.

 

            Clerk read a Fiscal Officer’s Certificate from Finance Director Rebecca Underwood regarding the proposed issuance of bonds for the purpose of acquiring real property for park and recreation purposes.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn thanked City staff and Council Members for their participation in the BG Experience at the University over the past weekend.

 

            Mayor Quinn noted that due to the recent resignation of Electric Superintendent Jerome Monaco that the former superintendent, Jerry Butterfield, has agreed to step in to that position throughout the hiring process.

 

            Municipal Administrator John Fawcett was not present.

 

            Council Member McOmber asked the Administration what methods were being used to inform the public and the student population regarding the City’s new civil infractions laws.  Mayor Quinn responded that information was given to the BG News, Sentinel Tribune, and a pamphlet was distributed through the City’s utility billing statements.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Director Michelle Grigore was not present.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard had no report.

 

            Public Works Director Bill Blair updated Council on recent project bid openings and current Public Works projects and paving.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Tomashefski, for the Finance Committee, introduced a resolution transferring previously appropriated funds.

 

            Council Member Tomashefski, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2006 and ending December 31, 2006.

 

            Council Member Tomashefski, for the Finance Committee, introduced an ordinance to provide for the issuance of bonds for the purpose of acquiring real property for park and recreation purposes.

 

            Council Member Tomashefski, for the Finance Committee, introduced an ordinance adjusting the salary for the Wastewater Collection Supervisor and a Public Works Supervisor, and declaring an emergency.

 

 

COUNCIL COMMITTEE REPORTS

 

            There were no Council committee reports.

 

 

LOBBY VISITATIONS

 

            Jack Hartman, 1400 Wren Road, addressed Council regarding the proposed library parking lot on the corner of N. Church Street and Court Street.  Mr. Hartman asked Council to seek the opinion of an independent counsel regarding the City’s authority to rezone the property in question.  He also asked Council to check into releasing the nine parking spaces in the current library parking lot that are currently used by the City employees.

 

            William Feeman, 1301 S. Orleans, agreed with Mr. Hartman’s request for Council to hire an independent counsel regarding the library parking lot issue indicating that the City Attorney and the City Prosecutor were not unbiased in their opinions.

 

            Kim Layden, 254 S. Church Street, thanked Council and especially Council Member Zanfardino for their dedicated work and service to the City.  She also agreed with Mr. Hartman’s request for an independent counsel.

 

 

READING OF LEGISLATION

 

            Clerk read Resolution #3311 transferring previously appropriated funds, for first reading.

 

            Council Member Tomashefski moved, McOmber seconded, to suspend the rules and give Resolution #3311 its second and third reading.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Resolution #3311 for second and third reading by number and title only.

 

            Council Member Tomashefski moved, Zanfardino seconded, to adopt Resolution #3311.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, and Heminger voted yes.  Council President Newlove declared motion carried, and Resolution #3311 adopted.

 

            Clerk read Ordinance #7597 providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2006 and ending December 31, 2006, for first reading.

        

  

Council Member Tomashefski moved, Zanfardino seconded, to suspend the rules and give Ordinance #7597 its second and third reading.  On roll call vote, Council Members Newlove, Sorrells, Tomashefski, Zanfardino, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and rules suspended.

            Council Member Tomashefski moved, Zanfardino seconded, to adopt Ordinance #7597.  On roll call vote, Council Members Sorrells, Tomashefski, Zanfardino, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7597 adopted.

 

            Clerk read Ordinance #7598 to provide for the issuance of bonds for the purpose of acquiring real property for park and recreation purposes, for first reading.

            Clerk read Ordinance #7591 authorizing the Municipal Administrator to seek proposals and enter into a contract or contracts for professional cleaning services for the City Administrative Services Building and the Municipal Court Building, for second reading.

 

            Clerk read Ordinance #7592 amending and adopting Section 30.116(B) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding the Bicycle Safety Commission, for second reading.

 

            Clerk read Ordinance #7593 authorizing the Municipal Administrator and the Utilities Director to sell obsolete items no longer needed for municipal purposes by public auction, and declaring an emergency, for second reading.

 

            Clerk read Ordinance #7594 establishing interim zoning of I-1 Institutional zoning for the approximately 42.016 acres of land on Gorrill Road recently annexed to the City of Bowling Green, Ohio, by the Bowling Green Church of the Nazarene, for second reading.

 

            Clerk read Ordinance #7595 amending and adopting Section 150.21 of the Codified Ordinances of the City of Bowling Green, Ohio, concerning the maximum height limit in M-1 Districts, for second reading.

 

            Clerk read Ordinance #7596 amending Ordinance #6842 with respect to the S-District Site Plan for the P & D Development on Klotz Road, for second reading.

 

            Clerk read Resolution #3309 authorizing the Municipal Administrator to enter into a contract to provide fire protection for the Wood County Agricultural Society, for third reading.

        

  

Council Member Sorrells moved, Zanfardino seconded, to adopt Resolution #3309.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, and Heminger voted yes.  Council President Newlove declared motion carried, and Resolution #3309 adopted.

 

            Clerk read Resolution #3310 authorizing the Mayor of the City of Bowling Green, Ohio, to file an application(s) with the Ohio Department of Transportation for grants through the US DOT Federal Transit Administration (FTA), as authorized under Federal Transit Laws, as Codified, 49 USC, Section 5311, Financial Assistance for other than urbanized areas and funds available from the Ohio Public Transportation Grant Program and executing a contract with the Ohio Department of Transportation upon grant application approval, for third reading.

 

            Council Member Sorrells moved, McOmber seconded, to adopt Resolution #3310.  On roll call vote, Council Members Newlove, Sorrells, Tomashefski, Zanfardino, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Resolution #3310 adopted.

 

            Clerk read Ordinance #7585 amending and adopting Section 33.21 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to personal business leave, for third reading.

 

            Council Member Tomashefski moved, Zanfardino seconded, to adopt Ordinance #7585.  On roll call vote, Council Members Sorrells, Tomashefski, Zanfardino, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7585 adopted.

 

            Clerk read Ordinance #7586 adopting Section 33.03(C) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to pay for School Police, Interns, and Civil Infractions Hearing Officer, for third reading.

 

            Council Member Tomashefski moved, Zanfardino seconded, to adopt Ordinance #7586.  On roll call vote, Council Members Tomashefski, Zanfardino, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7586 adopted.

 

            Clerk read Ordinance #7587 amending and adopting Section 33.03(A) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to pay for School Police, Interns, and Civil Infractions Hearing Officer, and declaring an emergency, for third reading.

 

            Council Member Tomashefski moved, Heminger seconded, to adopt the emergency clause for Ordinance #7587.   On roll call vote, Council Members Zanfardino, Heminger, McOmber, Newlove, Sorrells, and Tomashefski voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted. 

 

            Council Member Tomashefski moved, Zanfardino seconded, to adopt Ordinance #7587.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7587 adopted.

 

            Clerk read Ordinance #7588 authorizing the Municipal Administrator to enter into a contract with the Ohio Department of Transportation for the widening of North Main Street (State Route 25) project, and declaring an emergency, for third reading.

 

            Council Member Tomashefski moved, McOmber seconded, to adopt the emergency clause for Ordinance #7588.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, and Heminger voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Tomashefski moved, McOmber seconded, to adopt Ordinance #7588.  On roll call vote, Council Members Newlove, Sorrells, Tomashefski, Zanfardino, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7588 adopted.

        

  

Clerk read Ordinance #7589 authorizing the Utilities Director to execute the sixth modification to the Northwest Area Service Group Pool Participant Schedule, for third reading.

 

            Council Member McOmber moved, Sorrells seconded, to adopt Ordinance #7589.  On roll call vote, Council Members Sorrells, Tomashefski, Zanfardino, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7589 adopted.

 

            Clerk read Ordinance #7590 accepting annexation of approximately 42.016 acres of land in Plain Township, Wood County, Ohio, from Bowling Green Church of the Nazarene, petitioner, for third reading.

 

            Council Member McOmber moved, Sorrells seconded, to adopt Ordinance #7590.  On roll call vote, Council Members Tomashefski, Zanfardino, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7590 adopted.

 

            Council Members moved, McOmber seconded, to excuse Council Member Frost from this evening’s meeting.  On roll call vote, Council President Newlove declared motion carried.

 

Council Member Zanfardino moved, McOmber seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the August 21, 2006 regular meeting of the City Council at 8:33 p.m., subject to call.
