CITY OF BOWLING GREEN CITY COUNCIL

 

MONDAY, MAY 5, 2008

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:10 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.

 

Council President Newlove declared the minutes of the meeting held April 21, 2008 approved as distributed.

            Municipal Administrator John Fawcett noted that Council has legislation tonight approving the labor contract for the Bowling Green Employees Organization.  Fawcett reported that the contract was settled in 4½ days.  Fawcett requested that Council give the legislation three readings and adopt the emergency clause this evening in order to have the contract in place prior to the April 29 expiration of the existing contract.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Director Michelle Grigore reported that City Park will be closed on either May 15 or May 22 for treatment of the gypsy moths.  Grigore also announced that the dedication for the Children’s Garden at the Simpson Building will be held on June 1.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard reported that a solar and batter backup has been installed for the traffic signals at the corner of Main Street and Wooster Street in the downtown area.  Maynard noted that the battery backup will provide 7½ hours of backup power and then it will switch to the solar backup.

 

            Public Works Director Brian Craft reported that heavy item pickup is being performed throughout the city this week and that weather permitting the 2007 paving projects will be completed later this week.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and execute an agreement upon grant application approval under the Wood County Solid Waste District Grant Program.

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced an ordinance amending and adopting Section 96.02 and repealing 96.021 of the Codified Ordinances of the City of Bowling Green, Ohio, relative to sale to minors; prohibitions and misrepresentations.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator to sign a contract with the Bowling Green Employees Organization, and declaring an emergency.

 

            Council Member Sorrells, for the Transportation and Safety Committee, introduced an ordinance amending and adopting Section 35.30 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding rates for ambulance services.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to execute an agreement with Reiss Environmental, Inc., for engineering and construction oversight services for a 3MGD microfiltration/low pressure reverse osmosis addition to the Water Treatment Plant. 

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for microfiltration and low pressure reverse osmosis equipment for improvements at the Water Treatment Plant.

 

 

COUNCIL COMMITTEE REPORTS

 

            Council President Newlove reported that the Committee-of-the-Whole met earlier this evening to hear the Administration’s recommendation regarding standards for private streets becoming public in the city.  Council Member Dunn stated for the record that a property owner would have to demonstrate that they comply with all city standards or they would undertake to comply with all city standards in their development to be reclassified as a city street.

 

 

LOBBY VISITATIONS

 

            Earline Kilpatrick, Main Street BG, reported that 2008 Heritage Ohio Conference is being held in Bowling Green this week.  Ms. Kilpatrick explained that Heritage Ohio is the organization that oversees the Main Street programs across the state of Ohio and addresses core issues of downtown economic development and preservation.

 

 

READING OF LEGISLATION

 

            Clerk read Resolution #3363 authorizing the Mayor of the City of Bowling Green, Ohio, to file an application and execute an agreement upon grant application approval under the Wood County Solid Waste District Grant Program, for first reading.

 

            Council Member Zanfardino moved, Sorrells seconded, to suspend the rules and give Resolution #3363 its second and third reading.  On roll call vote, Council Members  Frost, Heminger, McOmber, Newlove, Sorrells, Zanfardino, and Dunn voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Resolution #3363 for second and third reading by number and title only.

 

            Council Member Zanfardino moved, Dunn seconded, to adopt Resolution #3363.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes.  Council President Newlove declared motion carried, and Resolution #3363 adopted.

 

            Clerk read Ordinance #7780 authorizing the Municipal Administrator to sign a contract with the Bowling Green Employees Organization, and declaring an emergency, for first reading.

 

            Council Member Newlove moved, Heminger seconded, to suspend the rules and give Ordinance #7780 its second and third reading.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Ordinance #7780 for second and third reading by number and title only.

 

            Council Member Newlove moved, Frost seconded, to adopt the emergency clause for Ordinance #7780.  On roll call vote, Council Members Newlove, Sorrells, Zanfardino, Dunn, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Newlove moved, Zanfardino seconded, to adopt Ordinance #7780.  On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7780 adopted.
