CITY OF BOWLING GREEN CITY COUNCIL
MONDAY, APRIL 7, 2008
The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove. The meeting began with the Pledge of Allegiance.
On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, and Zanfardino responded. Council Member Sorrells was not present. Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Brian Craft, Utilities Director Kevin Maynard, and Senior Planner Ken Taylor.
Council President Newlove declared the minutes of the meeting held March 17, 2008 approved as distributed.
CORRESPONDENCE
Clerk noted that an application for a new D5I liquor permit was received from the Ohio Division of Liquor Control for Ayo El Grande LLC, dba el Zarape, located at 1616 E. Wooster Street, Bowling Green, Ohio. Clerk noted that a check of the records was requested from the Police Division and no detrimental information was noted.
Clerk further noted for the record that the Municipal Court Annual Report was received and was distributed to Council at the March 17, 2008 Council meeting.
OFFICIAL REPORTS
Mayor John Quinn distributed a copy of a letter from the Human Relations Commission supporting the principals contained within House Bill 502 and Senate Bill 305 which would prohibit discrimination on the basis of sexual orientation or gender identity.
Mayor Quinn reported that the trees offered to the City of Tulsa if BGSU lost the GMAC Bowl game against them in January have been delivered.
Mayor Quinn displayed a poster honoring the 175th anniversary of Bowling Green that is being offered by the University. Mayor Quinn encouraged those interested in obtaining one should contact the university.
Mayor Quinn introduced John Rankins who presented an advertising award to Parks and Recreation employee Kristin Otley for the advertising campaign created for the Parks and Recreation Department. Mr. Rankins noted that this award, a Gold ADDY, is the highest local advertising award given at Toledo Advertising Club’s American Advertising Federation’s annual awards show.
Municipal Administrator John Fawcett reported that the City’s fire pumper truck that was damaged while responding to an alarm on the BGSU campus in October was returned to service Friday and is again operating out of the Court Street fire station.
Fawcett noted that bid openings will be held on Wednesday at 2:00 p.m. for the purchase of the new recycling/packer truck for Public Works and on Thursday at 2:00 p.m. for three new police cruisers.
Council Member Dunn asked what the kickoff date was for co-mingling of recyclables and if there was a plan for using the current red recycling bin that citizens are now using. Fawcett deferred the question to Public Works Director Brian Craft.
Planning Director Rick Ketzenbarger was not present. Senior Planner Ken Taylor had no report.
Parks and Recreation Director Michelle Grigore reported that the “Save the Woods” fundraising event held on March 29 yielded $140,000 toward the goal of $480,000.
City Attorney Michael Marsh had no report.
Utilities Director Kevin Maynard had no report.
Public Works Director Brian Craft reported that the target date for startup of the co-mingling of recyclables is November if the recycling center’s new building is finished by that time. Craft also noted that citizens can use their red recycling bin for glass and take it to the recycling center themselves as glass will no longer be collected curbside.
Craft reported that curbside unlimited brush pickup will start the week of April 14 beginning in Ward 4. Craft also reported that heavy item pickup will be done the week of May 5.
NEW LEGISLATION
The following new legislation was recommended by the Administration and presented to Council for introduction:
Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance accepting an easement from the Wood County Hospital for right-of-way purposes.

Clerk read Ordinance #7766 establishing interim zoning of I-1 Institutional zoning for the approximately 21.630 acres of land recently annexed to the City from Plain Township as petitioned for by Bowling Green Christian Academy, for second reading.
Clerk read Ordinance #7767 amending the Zoning District Map of the City of Bowling Green, Ohio, for approximately 6.027 acres of land generally known as 1165 Haskins Road from S-3 Planned Institutional and R-2 Single Family Residential to I-1 Institutional zoning as petitioned for by the Bowling Green Covenant Church, for second reading.
Clerk read Ordinance #7768 amending and adopting Section 150.03 and Section 150.90(C) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to rear yards and establishing revised definitions for “swimming pool”, “detention pond” or “retention pond”, for second reading.
Clerk read Ordinance #7769 amending and adopting Section 150.32(D)(3), Section 150.33(D)(3), and Section 150.33.5(C)(1) of the Codified Ordinances of the City of Bowling Green, Ohio, relating to daycare centers in M Districts, for second reading.
Clerk read Ordinance #7763 amending and adopting Section 33.18 of the Codified Ordinances of the City of Bowling Green, Ohio, relative to salaried employees not subject to overtime pay, for third reading.
Council Member Newlove moved, Dunn seconded, to adopt Ordinance #7763 On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, and Dunn voted yes. Council President Newlove declared motion carried, and Ordinance #7763 adopted.
Clerk read Ordinance #7764 amending and adopting Section 33.19 of the Codified Ordinances of the City of Bowling Green, Ohio, relative to overtime pay, for third reading.
Council Member Newlove moved, McOmber seconded, to adopt Ordinance #7764. On roll call vote, Council Members Heminger, McOmber, Newlove, Dunn, and Frost voted yes. Council President Newlove declared motion carried, and Ordinance #7764 adopted.
Council Member Frost moved, Dunn seconded, to adopt Ordinance #7762 amending and adopting Section 150.21 of the Codified Ordinances of the City of Bowling Green, Ohio, with respect to entranceways in the B-3 Central Business District. On roll call vote, Council Members McOmber, Newlove, Dunn, Frost, and Heminger voted yes. Council President Newlove declared motion carried, and Ordinance #7762 adopted.
Council Member Heminger moved, Dunn seconded, to excuse Council Member Sorrells from this evening’s meeting. On unanimous voice vote, Council President Newlove declared motion carried.
Council Member Zanfardino moved, Dunn seconded, to adjourn. On unanimous voice vote, Council President Newlove adjourned the April 7, 2008 regular meeting of the City Council at 8:15 p.m., subject to call.
