CITY OF BOWLING GREEN CITY COUNCIL

 

TUESDAY, SEPTEMBER 5, 2006

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.  Public Works Director Bill Blair was not present.

 

Council President Newlove declared the minutes of the meeting held August 21, 2006 approved as distributed.

 

 

CORRESPONDENCE

 

            There was no correspondence.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn had no report.

 

            Municipal Administrator John Fawcett reported that the City began enforcement of the new civil infraction ordinance on September 5.  Fawcett noted that information is available to citizens on the City’s website.

 

            Council Member Zanfardino questioned Fawcett regarding proposed legislation to reduce the number of days notice a property owner will receive to remove litter or noxious weeds from 15 days to 5 days.  Zanfardino proposed making the time shorter.

 

            Planning Director Rick Ketzenbarger had no report.

 

            Parks and Recreation Committee Michelle Grigore reported to Council that they are experimenting with advertising their program information in the Sentinel Tribune in an attempt to gain wider distribution.  In response to questions from Council Member Heminger, Grigore indicated that the information is also available on the Internet.

 

            City Attorney Michael Marsh had no report.

 

            Council Member Frost asked who would be taking City Prosecutor Matt Reger’s place who recently resigned.  Marsh responded that part-time prosecutor Steve Callejas will be taking his place.  Marsh also noted that Paul Skaff has been appointed as the Civil Infractions Hearing Officer.

 

            Utilities Director Kevin Maynard reviewed with the Council the history behind the need to replace the off gas piping at the Wastewater Treatment Plant.

 

            Public Works Director Bill Blair was not present.

 

 

NEW LEGISLATION

 

            The following new legislation was recommended by the Administration and presented to Council for introduction:

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution declaring support for the WSOS Indian Ridge Homeownership Project.

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced an ordinance amending and adopting Section 94.28(A) & (B) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding noxious weeds; notice to remove; failure to comply, and declaring an emergency.

          

 

Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to execute Change Order Number 2 with Mosser Construction Company for removal and replacement of off gas piping and other modifications to the 2005 Wastewater Treatment Plant improvements, and declaring an emergency.

 

Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to execute an agreement with Wood County Board of Commissioners an/or the Wood County Engineer for the Belleville Ditch Enclosure from Conneaut Avenue to Bourgogne Avenue, and to advertise for bids and enter into a contract or contracts for said project, and declaring an emergency.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an Ordinance authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the supplying of annual inventory requirements, petroleum products, and the sale of scrap materials for calendar year 2007 for the Municipal Utilities Department.

 

 

COUNCIL COMMITTEE REPORTS

 

            Council Member Newlove reported that the Committee-of-the-Whole met earlier this evening to discuss the City’s role in the library’s parking lot issue.

 

 

LOBBY VISITATIONS

 

            Don Corley, Housing Development Coordinator, for WSOS Community Action Commission, addressed Council regarding a proposed resolution in support of a project in the Indian Ridge Subdivision located at the intersection of Sand Ridge Road and Rudolph Road.  Mr. Corley indicated that it their intention to construct 5 single family homes in that subdivision and sell them to families earning 80% or less of the area median income.  Mr. Corley noted that Council’s adopting of this resolution of support is a step in the process of complying with State regulations for projects of this type.

 

            William Feeman, 1301 S. Orleans, read a prepared statement to Council regarding his position that Council should gain the opinion of an independent counsel regarding the library intentions to build a parking lot on the corner of N. Church and Court Streets.

 

            Earlene Kilpatrick, Main Street BG, addressed Council saying that the City has received opinions from both the City Attorney and the County Prosecutor and that the law needs to be followed in the library parking lot situation.  She indicated that she did not support the hiring of an independent counsel.

 

 

READING OF LEGISLATION

            Council Member McOmber moved, Tomashefski seconded, to adopt the emergency clause for Ordinance #7601.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member McOmber moved, Zanfardino seconded, to adopt Ordinance #7601.  On roll call vote, Council Members Newlove, Sorrells, Tomashefski, Zanfardino, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7601 adopted.

            Council Member McOmber moved, Frost seconded, to adopt Ordinance #7602.  On roll call vote, Council Members Zanfardino, Frost, Heminger, McOmber, Newlove, Sorrells, and Tomashefski voted yes.  Council President Newlove declared motion carried, and Ordinance #7602 adopted.

 

            Clerk read Ordinance #7603 authorizing the Utilities Director to advertise for bids and enter into a contract or contracts for the supplying of annual inventory requirements, petroleum products, and the sale of scrap materials for calendar year 2007 for the Municipal Utilities Department, for first reading.

 

            Clerk read Ordinance #7598 to provide for the issuance of bonds for the purpose of acquiring real property for park and recreation purposes, for second reading.

 

            Clerk read Ordinance #7591 authorizing the Municipal Administrator to seek proposals and enter into a contract or contracts for professional cleaning services for the City Administrative Services Building and the Municipal Court Building, for third reading.

 

            Council Member Heminger moved, Tomashefski seconded, to adopt Ordinance #7591.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7591 adopted.

 

            Clerk read Ordinance #7592 amending and adopting Section 30.116(B) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding the Bicycle Safety Commission, for third reading.

 

            Council Member Zanfardino moved, Heminger seconded, to adopt Ordinance #7592.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7592 adopted.

 

            Mayor Quinn reminded Council that he has asked Council to review the City’s policy regarding term limits for City Boards and Commissions.

 

            Clerk read Ordinance #7593 authorizing the Municipal Administrator and the Utilities Director to sell obsolete items no longer needed for municipal purposes by public auction, and declaring an emergency, for third reading.


 

            Council Member Tomashefski moved, Frost seconded, to adopt the emergency clause for Ordinance #7593.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Tomashefski moved, Zanfardino seconded, to adopt Ordinance #7593.  On roll call vote, Council Members Newlove, Sorrells, Tomashefski, Zanfardino, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7593 adopted.

 

            Clerk read Ordinance #7594 establishing interim zoning of I-1 Institutional zoning for the approximately 42.016 acres of land on Gorrill Road recently annexed to the City of Bowling Green, Ohio, by the Bowling Green Church of the Nazarene, for third reading.

 

            Council Member Frost moved, Tomashefski seconded, to table Ordinance #7594 until September 18, 2006.  On roll call vote, Council Members Newlove, Sorrells, Tomashefski, Zanfardino, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7594 tabled until September 18, 2006.

 

            Clerk read Ordinance #7595 amending and adopting Section 150.21 of the Codified Ordinances of the City of Bowling Green, Ohio, concerning the maximum height limit in M-1 Districts, for third reading.

 

Council Member Frost moved, McOmber seconded, to table Ordinance #7595 until September 18, 2006.  On roll call vote, Council Members Tomashefski, Zanfardino, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7595 tabled until September 18, 2006.

 

            Clerk read Ordinance #7596 amending Ordinance #6842 with respect to the S-District Site Plan for the P & D Development on Klotz Road, for third reading.

 

            Council Member Frost moved, Heminger seconded, to adopt Ordinance #6842.  On roll call vote, Council Members Zanfardino, Frost, Heminger, McOmber, Newlove, Sorrells, and Tomashefski voted yes.  Council President Newlove declared motion carried, and Ordinance #6842 adopted.

 

Council Member Tomashefski moved, Frost seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the September 5, 2006 regular meeting of the City Council at 8:46 p.m., subject to call.
