CITY OF BOWLING GREEN CITY COUNCIL
MONDAY, NOVEMBER 20, 2006
The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove. The meeting began with the Pledge of Allegiance.
On roll call, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino responded. Also present were Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger. Mayor John Quinn was not present.
Council President Newlove commented that some corrections were made to the minutes prior to the meeting and declared the minutes of the meeting held November 6, 2006 approved as corrected.
CORRESPONDENCE
Clerk noted that a listing of budget transfers for the month of November, 2006 was received from Finance Director Rebecca Underwood and distributed to Council prior to the meeting for approval. Council Member Frost moved, Sorrells seconded, to approve the transfers as presented. On unanimous voice vote, Council President Newlove declared motion carried. A copy of the transfers is attached and made a part of these minutes.
Clerk noted that copies of the Budget Summary Report for the month of October, 2006 was distributed to Council prior to this evening’s meeting.
OFFICIAL REPORTS
Mayor John Quinn was not present.
Municipal Administrator John Fawcett had no report.
Planning Director Rick Ketzenbarger reported that the Housing Oversight Committee will be meeting on Thursday, November 30, at 7:00 p.m. and the Outdoor Advertising Commission will be meeting on Wednesday, November 29, at 7:00 p.m. Both meetings will be held in the Council Chamber.
Parks and Recreation Committee Michelle Grigore had no report.
City Attorney Michael Marsh had no report.
Utilities Director Kevin Maynard had no report.
Public Works Director Bill Blair reported that they are continuing to pick up leaves and are currently making their second pass through the city. Blair noted that they expect to make one more pass through the city. Blair also reported that there will be no refuse pick up on Thursday due to the Thanksgiving holiday, but both Thursday and Friday’s routes will be picked up on Friday.
NEW LEGISLATION
The following new legislation was recommended by the Administration and presented to Council for introduction:
Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution adopting and authorizing a Community Housing Improvement Program (CHIP) Policy & Procedure Manual for the period 2006 to 2009, as approved by the Ohio Department of Development, Office of Housing & Community Partnerships (OHCP).
Council Member Newlove, for the Finance Committee, introduced a resolution transferring previously appropriated funds.
Council Member Newlove, for the Finance Committee, introduced a resolution authorizing the Finance Director to change the classification of the “Parking Meter Fund” and “Off-Street Parking Fund” by establishing a special revenue fund entitled “Parking Fund” for the City of Bowling Green, Wood County, Ohio.
Council Member Newlove, for the Finance Committee, introduced a resolution authorizing the Finance Director to establish a special revenue fund entitled “Payroll Stabilization Fund” for the City of Bowling Green, Wood County, Ohio.
Council Member Newlove, for the Finance Committee, introduced a resolution authorizing the Finance Director to establish a capital project fund entitled “Equipment Capitalization Fund” for the City of Bowling Green, Wood County, Ohio.
Council Member Newlove, for the Finance Committee, introduced a resolution authorizing the Finance Director to establish a capital project fund entitled “Facility Capitalization Fund” for the City of Bowling Green, Wood County, Ohio.
Council Member Newlove, for the Finance Committee, introduced a resolution authorizing the Finance Director to establish a capital project fund entitled “Roadway Capitalization Fund” for the City of Bowling Green, Wood County, Ohio.
Council Member Newlove, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year January 1, 2006 and ending December 31, 2006.
Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator to enter into a contract with the Bowling Green Convention & Visitors Bureau for the promotion and publicizing of the City of Bowling Green, Ohio, to bring the patronage and business of cultural, educational, religious, professional and sports organizations into the City for the benefit of the citizens of the City and the business community thereof, for a period of two (2) years, and authorizing the payment of 55% of the revenue generated by the hotel-motel tax for said purpose, and declaring an emergency.
Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to accept an easement agreement for utility purposes with Debmar, Inc.
Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance authorizing the Municipal Administrator to enter into a contract with the Wood County Health Department for housing code enforcement, and declaring an emergency.
Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending and adopting Section 152.01(D) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding adoption of building codes.

LOBBY VISITATIONS
Sara Ramke, 323 S. Mercer Apt. 11, addressed Council Members regarding the “Dance Marathon” project and requested interested Council Members to contact her to help with the project.
READING OF LEGISLATION

Council Member Frost moved to amend Resolution #3317 by adding two sentences to the Land Usage Section on page 38. The two sentences are to read as follows:
“To maintain the downtown’s vibrancy, one must acknowledge future changes and the potential need for growth. There is also a need to avoid absolute restrictions hindering such growth.”
Frost also requested to remove a reference to Table 2 in the “Strategy Section” of the plan. Council Member Dunn seconded the motion. Council Member McOmber questioned whether the following sentence should be included in the proposed change as well. “It is just as important to recognize that neighborhoods will only continue to be vibrant with a prosperous downtown.” After some discussion among Council Members and the Planning Director, it was decided that that sentence had already been added by the Planning Commission but was not reflected in the document before Council. On roll call vote, Council Members Sorrells, Zanfardino, Dunn, Frost, Heminger, McOmber, and Newlove voted yes. Council President Newlove declared motion carried, and Resolution #3317 amended.

Clerk read Ordinance #7612 amending and adopting Section 33.04 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding pay scales for seasonal employees, for third reading.
Council Member Newlove moved, Dunn seconded, to amend Ordinance #7612 by substitution to reflect necessary changes due to the recent passage of State Issue 2 regarding the minimum wage. On roll call vote, Council Members Dunn, Frost, Heminger, McOmber, Newlove, Sorrells, and Zanfardino voted yes. Council President Newlove declared motion carried, and Ordinance #7612 amended by substitution.

Clerk read Ordinance #7613 amending and adopting Section 93.05 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding fires inside the city, for third reading.
Council Member Sorrells moved, Heminger seconded, to adopt Ordinance #7613. On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Zanfardino, Dunn, and Frost voted yes. Council President Newlove declared motion carried, and Ordinance #7613 adopted.
Clerk read Ordinance #7614 amending and adopting Section 93.52(B)(1) and Section 93.52(C) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding open burning in restricted areas, for third reading.
Council Member Sorrells moved, McOmber seconded, to adopt Ordinance #7614. On roll call vote, Council Members McOmber, Newlove, Sorrells, Zanfardino, Dunn, Frost, and Heminger voted yes. Council President Newlove declared motion carried, and Ordinance #7614 adopted.
