CITY OF BOWLING GREEN CITY COUNCIL

 

 

MONDAY, MARCH 6, 2006

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Newlove.  The meeting began with the Pledge of Allegiance.

 

On roll call, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino responded.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Utilities Director Kevin Maynard, and Planning Director Rick Ketzenbarger.  Public Works Director Bill Blair was not present.

 

Council President Newlove declared the minutes of the meeting held February 21, 2006 approved as distributed.

 

 

CORRESPONDENCE

 

            Clerk noted that a listing of budget transfers for the month of March was received from Finance Director Rebecca Underwood and distributed to Council prior to the meeting for approval.  Council Member Heminger moved, Tomashefski seconded, to approve the transfers as presented.  On unanimous voice vote, Council President Newlove declared motion carried.  A copy of the transfers is attached and made a part of these minutes.

 

            Clerk also noted for the record that the annual report from the Bowling Green Municipal Court was received on February 28, 2006 and reported that the statute requiring the court to submit their annual report has been changed from January 31 to March 31.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn  reported that an initial meeting of the Community Partnership was held last week and that approximately 30 people were in attendance.  Mayor Quinn also noted that there will be a town hall style meeting held on March 30, at 7:00 p.m. at the Bowling Green High School regarding underage drinking.

 

            Municipal Administrator John Fawcett had no report.

 

            Planning Director Rick Ketzenbarger had no report.

 

            City Attorney Michael Marsh had no report.

 

            Utilities Director Kevin Maynard had no report.

 

            Public Works Director Bill Blair was not present.

 

 

NEW LEGISLATION

 

            Council Member Heminger, for the Public Lands and Buildings Committee, introduced an ordinance granting an easement for right-of-way purposes to Buckeye Cablevision, Inc., and declaring an emergency.

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution adopting a Community Housing Improvement Strategy (CHIS) for the anticipated period 2007 to 2011 as approved by the Ohio Department of Development, Office of Housing & Community Partnerships (OHCP).

 

            Council Member Zanfardino, for the Community Improvement Committee, introduced a resolution by the Council of the City of Bowling Green, Ohio, on preventing nuclear terrorism.

          

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to enter into an easement agreement with JFD Services, LLC and Strawberry Fields Investments, LLC for electric and sewer purposes.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending Section 30.86(G) & (H) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding the duties of the Planning Director.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance establishing interim zoning of A-1 Agricultural zoning for the Waltz property located at 16518 Haskins Road recently annexed to the City of Bowling Green.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance establishing interim zoning of B-2 General Commercial zoning for the JFD Services LLC property located on Bowling Green Road West recently annexed to the City of Bowling Green.

 

 

COUNCIL COMMITTEE REPORTS

 

            There were no Council committee reports.

 

 

LOBBY VISITATIONS

 

            Phinneas Anderson, 230 Mulberry Street, Perrysburg, Ohio, addressed Council regarding the legislation preventing nuclear terrorism and thanked Council for their support.

 

 

READING OF LEGISLATION

 

            Clerk read Resolution #3299 adopting a Community Housing Improvement Strategy (CHIS) for the anticipated period 2007 to 2011 as approved by the Ohio Department of Development, Office of Housing & Community Partnerships (OHCP), for first reading.

 

            Clerk read Resolution #3300 by the Council of the City of Bowling Green, Ohio, on preventing nuclear terrorism, for first reading.

 

            Council Member Zanfardino moved, Frost seconded, to suspend the rules and give Resolution #3300 its second and third reading.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, and Frost voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Resolution #3300 for second and third reading by number and title only.

 

            Council Member Zanfardino moved, Tomashefski seconded, to adopt Resolution #3300.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Resolution #3300 adopted.

 

            Clerk read Ordinance #7541 granting an easement for right-of-way purposes to Buckeye Cablevision, Inc., and declaring an emergency, for first reading.

            Council Member Heminger moved, Tomashefski seconded, to adopt the emergency clause for Ordinance #7541.  On roll call vote, Council Members Sorrells, Tomashefski, Zanfardino, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and the emergency clause adopted.

 

            Council Member Heminger moved, Zanfardino seconded, to adopt Ordinance #7541.  On roll call vote, Council Members Tomashefski, Zanfardino, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7541 adopted.

            Clerk read Resolution #3298            extending support from the City of Bowling Green for the proposed South College Drive Senior Community, for second reading.

 

            Council Member Frost moved, McOmber seconded, to suspend the rules and give Resolution #3298 its third reading.  On roll call vote, Council Members Zanfardino, Frost, Heminger, McOmber, Newlove, Sorrells, and Tomashefski voted yes.  Council President Newlove declared motion carried, and rules suspended.

 

            Clerk read Resolution #3298 for third reading by number and title only.

 

            Council Member Frost moved, Tomashefski seconded, to adopt Resolution #3298.  On roll call vote, Council Members Frost, Heminger, McOmber, Sorrells, Tomashefski, and Zanfardino voted yes.  Council Member Newlove abstained.  Council President Newlove declared motion carried, and Resolution #3298 adopted.

 

            Clerk read Ordinance #7538 amending and enacting Section 33.01(I) of the Codified Ordinances of the City of Bowling Green, Ohio, relative to the non-bargaining salary schedule, for second reading.

 

            Clerk read Ordinance #7539 amending and adopting Section 33.04(D) of the Codified Ordinances of the City of Bowling Green, Ohio, regarding bonus pay for lifeguards, for second reading.

 

            Clerk read Ordinance #7540 authorizing the Utilities Director to execute a Hydro Matrix Development Cost Sharing Agreement with American Municipal    Power–Ohio, Inc., and declaring an emergency, for second reading.

 

            Clerk read Ordinance #7535            amending and adopting Sections 99.19, 99.21(A), and 94.28 of the Codified Ordinances of the City of Bowling Green, Ohio, regarding noxious weeds, for third reading.

            

            Council Member Zanfardino moved, Tomashefski seconded, to adopt Ordinance #7535.  On roll call vote, Council Members Heminger, McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, and Frost voted yes.  Council President Newlove declared motion carried, and Ordinance #7535 adopted.

 

            Clerk read Ordinance #7536 accepting annexation of approximately 1.54 acres of land in Plain Township, Wood County, Ohio, from Terry L. & Carolyn Waltz, petitioners, for third reading.

 

            Council Member Frost moved, Heminger seconded, to adopt Ordinance #7536.  On roll call vote, Council Members McOmber, Newlove, Sorrells, Tomashefski, Zanfardino, Frost, and Heminger voted yes.  Council President Newlove declared motion carried, and Ordinance #7536 adopted.

 

            Council Member Frost moved, Zanfardino seconded, to adopt Ordinance #7529 amending and adopting Section 150.103(D)(3)(c) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning grades for sidewalks.  On roll call vote, Council Members Newlove, Sorrells, Tomashefski, Zanfardino, Frost, Heminger, and McOmber voted yes.  Council President Newlove declared motion carried, and Ordinance #7529 adopted.

 

            Council Member Frost moved, Tomashefski seconded, to adopt Ordinance #7530 amending and adopting Sections 150.03 and 150.89(B), (C) and (D) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning awnings and canopies.  On roll call vote, Council Members Sorrells, Tomashefski, Zanfardino, Frost, Heminger, McOmber, and Newlove voted yes.  Council President Newlove declared motion carried, and Ordinance #7530 adopted.

 

            Council Member Frost moved, Zanfardino seconded, to adopt Ordinance #7531 amending and adopting Section 150.21, Section 151.37(P)(7), Section 151.37(Q)(5), and Section 151.45(D) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning cul-de-sacs.  On roll call vote, Council Members Tomashefski, Zanfardino, Frost, Heminger, McOmber, Newlove, and Sorrells voted yes.  Council President Newlove declared motion carried, and Ordinance #7531 adopted.

 

            Council Member McOmber moved, Tomashefski seconded, to remove from the table Ordinance #7521 authorizing the Utilities Director to execute a long-term power supply agreement with American Municipal Power-Ohio, Inc., for 6.5 MW of the J. Aron & Company power purchase.  On roll call vote, Council Members Zanfardino, Frost, Heminger, McOmber, Newlove, Sorrells, and Tomashefski voted yes.  Council President Newlove declared motion carried, and Ordinance #7521 removed from the table.

 

            Council Member McOmber moved, Zanfardino seconded, to adopt Ordinance #7521.  On roll call vote, Council Members Frost, Heminger, McOmber, Newlove, Sorrells, Tomashefski, and Zanfardino voted yes.  Council President Newlove declared motion carried, and Ordinance #7521 adopted.

 

Council Member Heminger moved, Tomashefski seconded, to adjourn.  On unanimous voice vote, Council President Newlove adjourned the March 6, 2006 regular meeting of the City Council at 8:20 p.m., subject to call.
