CITY OF BOWLING GREEN CITY COUNCIL

 

 

TUESDAY, JANUARY 17, 2006

 

 

The regular meeting of the Bowling Green City Council, held in the Council Chamber, 304 North Church Street, Bowling Green, Ohio was called to order at 8:00 p.m. by Council President Mura.  The meeting began with the Pledge of Allegiance and a moment of silence in memory of Jodi Stearns.

 

On roll call, Council Members Frost, Heminger, McOmber, Mura, Newlove, and Zanfardino responded.  Council Member Sorrells was not present.  Also present were Mayor John Quinn, Municipal Administrator John Fawcett, City Attorney Michael Marsh, Parks and Recreation Director Michelle Grigore, Public Works Director Bill Blair.  Utilities Director Kevin Maynard and Planning Director Rick Ketzenbarger were not present.

 

Council President Mura declared the minutes of the meeting held January 3, 2006 approved as distributed.

 

 

CORRESPONDENCE

 

            Clerk noted that a listing of budget transfers for the month of January was received from Finance Director Rebecca Underwood and distributed to Council prior to the meeting for approval.  Council Member Newlove moved, Frost seconded, to approve the transfers as presented.  On unanimous voice vote, Council President Mura declared motion carried.  A copy of the transfers is attached and made a part of these minutes.

 

            Clerk noted that copies of the Budget Summary Report for the month of December, 2005 was distributed to Council prior to this evening’s meeting.

 

 

OFFICIAL REPORTS

 

            Mayor John Quinn requested confirmation of the following appointments to City Boards and Commissions:

 

·         Bob McOmber – Cable Television Commission (no expiration date);

·         Larry Sorrells – Convention & Visitors Bureau (term expiring 10/31/06)

 

Council Member Heminger moved, Zanfardino seconded to approve the appointments as presented by the Mayor.  On unanimous voice vote, Council President Mura declared motion carried.

 

            Municipal Administrator John Fawcett reminded Council Members about the Council orientation meeting that will be held on Saturday, January 28, beginning at 9:00 a.m.

 

            Fawcett reported that the City will be receiving $312,699 in CDBG funds for FY2006 which is approximately $35,000 less than FY2005.

 

            Fawcett also reported that the City staff took the opportunity to tour the former National Guard Armory property noting that the State offered to sell the property to the City at a price of $280,000.  Fawcett noted that the staff is recommending that the City not purchase the property due to the age and condition of the property and the amount of money that would be needed to make the building usable.

 

            Planning Director Rick Ketzenbarger was not present.

 

            Parks and Recreation Committee Michelle Grigore reported that the sale of annual passes at the recreation center has reached 758 noting the goal for the first year is around 1500.

 

            Utilities Director Kevin Maynard was not present.

 

City Attorney Michael Marsh commented that as a result of the untimely death of part-time City Prosecutor Jodi Stearns, they will look at the case load over a period of time before making a recommendation regarding replacement.

       

 

Public Works Director Bill Blair had no report.

 

 

NEW LEGISLATION

 

            Council Member Zanfardino, for the Transportation and Safety Committee, introduced an ordinance authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for sidewalk improvements, pavement striping, deicing salt, and improving streets, alleys, and other public ways in the City of Bowling Green, Ohio.

 

            Council Member Newlove, for the Finance Committee, introduced a resolution adopting the “Citizen Participation Plan” as required by the Department of Housing & Urban Development.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance providing supplemental appropriations for the current expenses and other expenditures of the City of Bowling Green, Ohio, during the fiscal year beginning January 1, 2006 and ending December 31, 2006.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator and the Utilities Director to advertise for bids and enter into a contract or contracts and/or participate in State of Ohio purchase programs for the purchase of vehicles and equipment as well as the trade-in or outright sale of vehicles and equipment being replaced, and declaring an emergency.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing the Municipal Administrator to advertise for bids and enter into a contract or contracts for tree plantings & tree maintenance for trees located within the public right-of-way of the City of Bowling Green.

 

            Council Member Newlove, for the Finance Committee, introduced an ordinance authorizing an agreement between the City of Bowling Green, Ohio, and the Wood County Regional Airport Authority.

 

            Council Member Mura, for the Committee-of-the-Whole, introduced a resolution honoring William Culbertson, Member of the Council of the City of Bowling Green, Ohio.

 

            Council Member Mura, for the Committee-of-the-Whole, introduced a resolution honoring William J. Fischer, Member of the Council of the City of Bowling Green, Ohio.

 

            Council Member Mura, for the Committee-of-the-Whole, introduced a resolution honoring Sarah Tomashefski, Member of the Council of the City of Bowling Green, Ohio.

 

            Council Member Mura, for the Committee-of-the-Whole, introduced a resolution honoring Michael Zickar, Member of the Council of the City of Bowling Green, Ohio.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance accepting an easement for utility purposes from Carrols Corporation/M2 Real Estate Holdings, LLC.

 

            Council Member McOmber, for the Public Utilities Committee, introduced an ordinance authorizing the Utilities Director to execute a Pole Attachment Agreement with Robert W. & Patricia A. Maurer to supply electric service to a sign located at 1236 West Wooster Street.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending and adopting Section 150.103(D)(3)(c) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning grades for sidewalks.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending and adopting Sections 150.03 and 150.89(B), (C) and (D) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning awnings and canopies.

 

            Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance amending and adopting Section 150.21, Section 151.37(P)(7), Section 151.37(Q)(5), and Section 151.45(D) of the Codified Ordinances of the City of Bowling Green, Ohio, concerning cul-de-sacs.

 

           

Council Member Frost, for the Planning, Zoning and Economic Development Committee, introduced an ordinance accepting annexation of approximately 5.2422 acres of land in Plain Township, Wood County, Ohio, from JFD Service, LLC, petitioner.

 

 

COUNCIL COMMITTEE REPORTS

 

            Council discussed the Administration’s recommendation regarding the purchase of the Armory property and agreed that the size of the parcel, age and condition of the building are not favorable and that renovating the property is cost prohibitive.  Therefore, Council’s recommendation was to not pursue the acquisition of the former Armory property.

 

            Council Member Heminger moved, Newlove seconded, to accept the recommendation of the Charter Review Committee to not place any initiatives on the ballot at this time regarding the hiring of Police and Fire Chiefs.  It was recommended that the City’s Charter be reviewed on a regular basis.  On unanimous voice vote, Council President Mura declared motion carried.

            Clerk read Ordinance #7519 authorizing the Utilities Director to execute a generic mutual aid agreement prepared by the American Public Power Association (APPA), National Rural Electric Cooperative Association (NRECA), and the Federal Emergency Management Agency (FEMA), for third reading.

 

            Council Member McOmber moved, Newlove seconded, to table Ordinance #7519 until February 6, 2006.  On roll call vote, Council Members Frost, Heminger, McOmber, Mura, Newlove, and Zanfardino voted yes.  Council President Mura declared motion carried, and Ordinance #7519 tabled until February 6, 2006.

 

            Clerk read Ordinance #7520 amending and adopting certain revisions to Chapter 50 of the Codified Ordinances of the City of Bowling Green, Ohio, relating to sewer service and the Wastewater Treatment Plant and sewage collection system pre-treatment plan, for third reading.

 

            Council Member McOmber moved, Frost seconded, to table Ordinance #7520 until February 6, 2006.  On roll call vote, Council Members Heminger, McOmber, Mura, Newlove, Zanfardino, and Frost voted yes.  Council President Mura declared motion carried, and Ordinance #7520 tabled until February 6, 2006.

 

            Clerk read Ordinance #7521 authorizing the Utilities Director to execute a long-term power supply agreement with American Municipal Power-Ohio, Inc., for 6.5 MW of the J. Aron & Company power purchase, for third reading.

 

            Council Member McOmber moved, Newlove seconded, to table Ordinance #7521 until February 6, 2006.  On roll call vote, Council Members McOmber, Mura, Newlove, Zanfardino, Frost, and Heminger voted yes.  Council President Mura declared motion carried, and Ordinance #7521 tabled until February 6, 2006.

 

            Council Member Frost moved, Zanfardino seconded, to excuse Council Member Sorrells from this evening’s meeting.  On unanimous voice vote, Council President Mura declared motion carried.

  

Council Member Heminger moved, Zanfardino seconded, to adjourn.  On unanimous voice vote, Council President Mura adjourned the January 17, 2006 regular meeting of the City Council at 8:42 p.m., subject to call.
